Sellers and retailers in most States assume the obligation to collect, report, and remit sales tax. Because merchants collect, hold and remit sales taxes as fiduciaries for their clients, States take compliance seriously. Failure to comply with the sales tax laws may lead to tax assessments, interest and penalties. If a business is not carefully and properly reporting their sales tax, they will likely face substantial penalties, or a criminal investigation.
